The State Council has revealed that there are ongoing proceedings against the state for a number of guerrilla attacks that took place in the 1990s, newspaper El Espectador reported Wednesday.
State Council President Mauricio Fajardo said that, in addition to the process initiated in the “Las Delicias” case, there are other ongoing judicial processes against the state for FARC attacks on military bases and installations.
Lawsuits are currently being carried out against the state for the Mitu attack of November 1998, the El Billar attack of March 1998, and the Patascoi attack of December 1997.
In the Mitu attack in the eastern Vaupes department, 43 people were killed, 47 injured and 61 people were kidnapped. In El Billar, in the southern department of Caqueta, 65 soldiers were killed and 43 were taken captive. In the case of Patascoi, 19 people were taken captive.
Regarding questions over whether or not the State Council took into account the financial capability of the nation to pay compensation, Fajardo said that within a constitutional framework, the state must respond monetarily for unlawful damage. He said “We have kept the same parameters for compensation which have been used in the past.”
The State Council ordered the Colombian state to pay almost $1 million in compensation to the victims of the guerrilla attack on Las Delicias base in which over 100 people were either killed, injured or taken hostage to to negligent and delayed response by military leadership.
