The head of the Colombian Family Welfare Institute (ICBF), Diego Molano, claimed gay couples have not been formally granted adoption rights, according to a report from RCN Radio.
Molano’s statement was in reference to a court ruling passed down Tuesday which reinstated custody of two Colombian boys to their adopted gay father, U.S. journalist Chandler Burr.
“In this particular case the sentence does not refer to homosexual couples. In this case the judgment relates to a single person. The Constitutional Court is defining the modification of the law, and not as in this case which speaks to the sexual orientation of a single person,” said Molano.
The ruling, T-276 2012, says that the sexual orientation of the adoptive parent cannot be considered a risk factor, but makes no reference to the parent’s marital status.
Molano said that he respected the court’s decision, but that the ICBF would continue to monitor the adoption of Colombian children by foreign gay prospective parents.
